Inirekomenda ng Field Investigation Bureau ng Office of the Ombudsman ang pagsasampa ng kasong plunder at bribery laban kay Senator Rodante Marcoleta kaugnay ng umano’y ₱75 milyong campaign donations noong nakaraang taon.
Sa isang complaint-affidavit na may petsang May 18, inirekomenda rin ng mga imbestigador ang pagsasampa ng kaso laban kina dating Quezon City 2nd District Rep. Mike Defensor at dalawa pang indibidwal na umano’y nagbigay ng donasyon kay Marcoleta.
“…the undersigned investigators respectfully pray that the following respondents Rodante Dizon Marcoleta and private individuals Michael Tan Defensor, Joseph Varias Espiritu, and Aristotle Baluyut Viray be indicted for Plunder, as defined and penalized under Republic Act No. 7080, and for violation of Presidential Decree no. 46,” ayon sa complaint-affidavit.
Inirekomenda rin ang kasong indirect bribery laban sa apat na akusado.
Pinagpapasa rin ng kanilang counter-affidavits ang mga respondents bilang bahagi ng preliminary investigation ng Ombudsman.
Ayon sa ulat, nag-ugat ang kaso sa naunang imbestigasyon ng Commission on Elections (Comelec) kaugnay ng hindi pagdeklara ng mga donasyon sa Statement of Contributions and Expenditures (SOCE) ni Marcoleta.
Gayunman, sinabi ng Comelec na hindi na ito election offense sa ilalim ng amended Omnibus Election Code.
Ngunit giit ng Ombudsman investigators, may pananagutan pa rin umano si Marcoleta.
“While respondent Marcoleta’s failure to declare the donations/contributions from respondents Defensor, Espiritu, and Viray did not constitute any election offense, his acts … should nevertheless give rise to criminal and administrative liabilities,” ayon sa complaint-affidavit.
Sa imbestigasyon ng Comelec, inamin umano ni Marcoleta na nakatanggap siya ng tatlong hiwalay na donasyon mula kina Defensor, Espiritu, at Baluyut noong Enero 2025 na umabot sa ₱75 milyon.
Nag-donate umano si Defensor ng ₱30 milyon, habang ₱25 milyon at ₱20 milyon naman mula kina Espiritu at Viray sa tatlong magkakahiwalay na petsa noong Enero 6, 8, at 9, 2026.
Itinuturing na mga co-conspirator sina Defensor, Espiritu at Viray.
Ayon pa sa Ombudsman investigators, ang ₱75 milyon ay hindi na maituturing na simpleng donasyon lamang.
“can no longer be considered as an ordinary act of generosity but rather a corrupt act … the acceptance of such manifestly excessive amount should not be normalized among public officers,” ayon sa complaint-affidavit.
Para naman kay Defensor, kinuwestyon niya ang motibo ng Ombudsman at iginiit na walang basehan ang mga kaso.
“How can it be plunder? No gov’t funds were involved. Dapat ‘yung fina-filean ng plunder, ‘yung totoong nagnakaw sa flood control project,” Ani Defensor.
